CASL basics: email and text marketing rules for Canadian businesses
· Business Pilot
If you send marketing emails or texts to customers in Canada, Canada's Anti-Spam Legislation (CASL) applies. This is a plain-language overview, not legal advice. Check the official guidance from the CRTC for the details that apply to you.
The three basics
- Consent: have permission to send, either express (they opted in) or implied in certain limited situations
- Identification: say clearly who the message is from and how to reach you
- Unsubscribe: include an easy way to opt out and honour it promptly
Practical habits
- Use an unticked checkbox or clear wording on sign-up forms
- Record when and how each person opted in
- Keep business contact details in every message footer
- Make sure your software removes unsubscribed contacts automatically
